Terms of Service

You must provide a valid email address to create an account. You are responsible for keeping your password secure and for all activity that happens under your account. Notify us at joe@desaneteam.com if you believe your account has been compromised.

You must be at least 13 years old to create your own account. Users under 13 may only use the Service through a parent or coach account under the parent or coach's supervision.

The Service offers a free tier and paid plans (Founder, Player, and Coach). Current pricing is listed at itlbaseball.com/pricing. Payments are processed by Stripe. We do not store your card details.

Subscriptions (Player and Coach) auto-renew on their billing cycle (monthly or yearly) until you cancel. You can cancel any time from your account. Cancellation stops future charges. Access continues through the end of the current paid period.

Founder is a one-time payment that grants lifetime access to the tiers and features included in the Founder plan at time of purchase. Founder is limited to the first 100 accounts.

Founder purchases are final sale and non-refundable. The Founder plan is a one-time discounted lifetime purchase limited to the first 100 accounts. Because of the limited-quantity nature of this offer and its lifetime benefit, we do not issue refunds on Founder purchases under any circumstances.

Subscription refunds (Player and Coach). New subscribers may request a refund of their first month's charge within seven (7) days of that first charge by emailing joe@desaneteam.com. After that seven-day window, and for all renewals (monthly or yearly) after the first, subscription payments are non-refundable. We do not prorate or credit unused subscription time. If you no longer want to be billed, cancel before the next billing date.

Refund requests must come from the account's registered email address. Approved refunds are issued to the original payment method within 5-10 business days.

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service and its content (drills, jingles, buzzers, and other audio) for your own baseball training. You may not resell, sublicense, rent, or otherwise commercialize the Service or its content.

When you use the Service, you may create data (session logs, roster entries, notes, drill configurations). You retain ownership of that data. You grant us a limited license to store, process, and display your data as needed to operate the Service.

If you use a Coach account to enter a player's name or roster information, you represent that you have permission from the player or the player's parent or guardian to do so, and that the information is truthful.

The Service, including its interface, branding, drill library, audio content (jingles and buzzers), and all software, is owned by ITL Baseball or its licensors. Your license under Section 4 does not transfer any ownership.

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code
• Scrape, mirror, or bulk-download the audio library or drills
• Use the Service to harass, harm, or infringe on any person's rights
• Interfere with the Service or bypass rate limits and paywalls
• Impersonate another user or misrepresent your affiliation with anyone

You may delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the Service. On termination, your license under Section 4 ends and your access will be revoked.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any results (in performance, timing, or otherwise) will be achieved. Baseball training carries physical risk; consult a qualified coach or medical professional before starting or intensifying training.

To the fullest extent allowed by law, ITL Baseball is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, whether in contract, tort, or otherwise. Our total liability for any claim arising out of or related to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim, or $20, whichever is greater.

You agree to defend, indemnify, and hold harmless ITL Baseball from any claim, liability, damage, or expense (including reasonable attorneys' fees) arising from your use of the Service, your content, or your breach of these Terms.

We may update the Service and these Terms from time to time. If we make material changes, we will post the updated Terms here and update the "Last updated" date. Your continued use after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts in Palm Beach County, Florida, and you consent to that jurisdiction.
